What Marcia Pangburn wanted was simple: She wanted to clear her name.

NEW SCOTLAND — A jury trial here is scheduled in July for Marcia Pangburn, arrested in Berne last summer for resisting arrest and obstructing governmental administration.

A transfer request was made because both judges in Berne recused themselves to avoid the appearance of impropriety and to "insure the appearance of fairness" in Marcia Pangburn's case, in which she is charged with resisting arrest and obstructing governmental administration.

Marcia Pangburn's lawyer thinks she should have a jury in Berne, where she was arrested, but both town judges believe there may be an appearance of bias; a county judge will decide.

Marcia Pangburn, who was arrested for resisting arrest and obstructing governmental administration last summer, said she felt the hearing, where her attorney asked questions for most of the three hours, did not go well for her.

The hearing will review evidence, testimony and Pangburn's statements as she was arrested late at night visiting a Berne cemetery, to determine whether the evidence should be suppressed.

Five of Marcia Pangburn's neighbors from Thompsons Lake  sat with her as she waited in court.

BERNE — A woman was questioned by police as she mourned in a cemetery in the early morning hours of July 13. A breath sample at the police station, according to her arrest report, registered .01, well below the legal limit of .08 for driving. Meanwhile, her SUV had been towed from the cemetery and she had to pay $265 to get it back.
