Westerlo man arrested for sexual misconduct

WESETERLO — State Police have arrested a Westerlo man twice in recent months for his involvement with a minor.

Justin A. O’Toole, 20, was arrested on Dec. 24 by State Police in Princetown for sexual misconduct and endangering the welfare of a child when he turned himself in for being sexually involved with a 15-year-old girlfriend in separate incidents in Rotterdam and Glenville, according to police.

The legal age for sexual consent in New York State is 17.

“Based on a previous arrest, he knew he was the subject of an investigation,” said William John, senior investigator for Princetown State Police.

According to John, the December arrest was part of a continuing investigation that was started when the parents of the girl reported her missing in November, last seen at Crossgates Mall in Guilderland. She was located the next day in Westerlo and, according to the State Police, investigation led to the discovery she was involved with O’Toole.

O’Toole was arrested by Catskill State Police for that incident on Nov. 28 for endangering the welfare of a child when he was discovered with the 15-year-old in Westerlo.

Following the November arrest, O’Toole was arraigned in Greenville Town Court. April Saccoccio, Greenville court clerk, said a stay away order of protection was issued on Nov. 28, prohibiting O’Toole from contact or proximity with the 15-year-old. He was told on Dec. 19 to retain an attorney, and is scheduled to appear in Greenville court on Jan. 16 at 6 p.m.

Related to the Dec. 24 arrest, O’Toole is to appear in the Rotterdam Town Court on Jan. 10 at 5 p.m., and in the Glenville Town Court on Jan. 17, at 5:30 p.m.
