Amended Appeal Request # 435: The appeal of Mr. Gerald Lenseth is two fold. The first part is a request for an interpretation of Section 4. Definitions of the “Wireless Telecommunications Facilities Siting Law” in an appeal to overturn the Building Inspectors decision denying a Special Use Permit application for a tower to be treated as a Special Use under the Zoning Law, Chapter 190 rather than under the “Wireless Telecommunications Facilities Siting Law”. Should the application be denied, the second part is a request for a temporary use permit to allow for the installation of a meteorological research tower which includes an area variance request to allow 125’ of relief from the maximum allowable structure height of 45’, as identified in Chapter 190-29(B)(2) of the Zoning Law, to be allowed to erect the tower to a height of 170’. The site of issue is owned by Mr. Lenseth, is located within the RF district off Pinnacle Road and is identified as New Scotland tax parcels # 82.-1-8.
